"전문지식과 봉사정신 있는 법률가 교육모델 삼아"
▲현재 한국에서 법조인 양성제도로 로스쿨 도입에 대한 논의가 일고 있습니다. 미국 변호사시험을 목표로 하는 한동국제법률대학원을 설립하게 된 취지는.
한동 로스쿨을 설립하게 된 주된 동기는 21세기 지구촌 모든 영역에서 법률가들이 성실하고 효과적으로 역할을 수행할 수 있는 교육 모델을 발전시키는 데 있습니다.
지금 전통적인 법학 교육도 국제적인 환경에 순응해야 하고 국제법에 대한 이해와 국가간의 협상, 자문과 다문화에 대한 새로운 법률 기술이 요구되고 있습니다.
또 고도의 전문적인 도덕 기준과 봉사 정신이 투철한 법률가들은 개발도상국들에게 민주적이고 자유로운 사회와 시장을 확립하는데 일조할 수 있다고 생각합니다. 따라서 법률가들은 권력과 지위를 갖는 그 이상이어야 하며, 법을 수행하는 법률가들이 봉사하는 자로 회복하고 법의 정의를 확립해야 하기 때문입니다.
▲한동 로스쿨의 커리큘럼에 대해 자세히 설명해주신다면.
커리큘럼은 3년간의 과정동안 105학점을 이수해야하며, 이 프로그램은 법률가에게 중요한 지식과 기술을 발전시켜주는 광범위한 분야를 포함하게 됩니다.
좀더 구체적으로 보면, 미국 변호사 시험에서 요구하는 민사법(torts), 계약법(contracts), 재산법(property) 등과 같은 전통적인 과목뿐만 아니라 여러 분야도 해당됩니다. 가령 비교법(comparative law), 국제무역 및 비즈니스법(international trade and business law), 인권(human rights)과 국제공법(int'l public law)과 같은 국제적인 법률행위와 관련된 분야입니다.
또한 법률가로서 기술적인 측면에 중점을 둔 협상(negotiations), 법정변론(trial advocacy), 법률검토(legal analysis), 합작투자(joint ventures), 법률상담(legal counseling) 등을 강의합니다. 또 법철학(jurisprudence), 기독교와 법(Christianity and law), 윤리와 리더십 원리(ethics and leadership principles) 등과 같은 근본적인 원리에 초점을 맞춘 강좌가 있습니다.
법의 가장 기본적인 특징은 가치와 비전이라고 생각합니다. 따라서 법률가에게는 인간의 존엄성에 대한 분명한 신념, 의무와 인권, 그리고 정의에 대한 열정이 필요합니다. 또 법률가는 오늘날의 문화적인 문제, 민주적인 제도, 정치, 경제, 사회분야를 이해해야 합니다. 그러므로 매주 포럼을 통해 이라크 전쟁이나 한국의 햇볕정책 같은 문제들을 토론합니다.
▲한동국제법률대학원의 학점이 미국 로스쿨에서 인정을 받는지. 또한 졸업생들이 미국 변호사 시험에 응시할 수 있는지.
미국변호사협회는 캐나다를 제외하고 미국 외의 로스쿨에 대해서는 공식적으로 인정하지 않습니다. 하지만 각 주들은 어떤 자격요건을 갖추어야 변호사 시험에 응시할 수 있는지에 대한 규정을 가지고 있습니다. 몇몇 주들은 미국 외의 로스쿨 졸업생들에게 주의 변호사 시험에 응시할 수 있도록 허가해줍니다. 그 외의 주들은 인가받은 미국 로스쿨에서 LL.M.을 마친 미국 외 로스쿨 졸업생들에게 변호사 시험에 응시할 수 있도록 허가합니다.
따라서 한동국제법률대학원의 프로그램은 미국변호사협회(ABA)의 요구 조건을 충족시키고 있고 미국의 로스쿨과 친밀한 관계를 맺어왔기 때문에 한동국제법률대학원 졸업생들이 미국변호사 시험에 응시할 수 있는 기회를 제공합니다.
▲한동국제법률대학원 졸업생의 진로는.
진로는 어떤 대학원 프로그램에서도 중요한 문제다. 서구에서 법률학위는 여러 분야에 진출할 수 있는 일종의 ‘자격 증명서'다. 우선 졸업생들이 전통적인 법률분야에 진출할 수 있습니다. 또한 많은 졸업생들이 기업, 비영리 단체, 인권단체, 국회나 행정부 등의 분야로도 나갈 수 있습니다. 특히 한동국제법률대학원 졸업생들은 국제분야와 급속히 개혁하고 있는 아시아에 상당한 관심을 갖고 있습니다.
훌륭한 법률 교육은 학생들에게 생각해보지 못했던 새로운 분야와 기회를 제공하게 될 것입니다. 그래서 한동국제법률대학원의 임무는 첫째, 학생들에게 광범위한 법률 기술과 지식을 갖추게 하는 것입니다. 둘째, 다양한 직업 선택을 접하게 하고 마지막으로 졸업생들이 봉사할 수 있는 법률단체, 기업 및 정부와 연계시켜 주는 일입니다.
▲한동국제법률대학원의 비전은 무엇인지.
비전은 21세기 법률가에게 필요한 독특하고 높은 자질을 제공하는 것입니다. 한동국제법률대학원의 커리큘럼은 독특하며 학생들로 하여금 참여와 창의력을 강조하고 옹호자와 변화의 주체로 법률가를 훈련시키는 것입니다.
또한 한동국제법률대학원은 영적이고 도덕적인 원리를 강조함으로써 ‘세상을 변화시켜라’는 대학의 모토를 실현하고 법률가로서 높은 비전을 찾고자 합니다.

[인터뷰 원문]
1.There has been some arguments over the matters re implementation of the American law school system in Korea. What was the motivation of establishing Handong International Law School, which pursues passing the US BAR, under Handong Global University.
The primary motive is to develop an educational model that equips lawyers to function effectively and with integrity in the global legal and business world of this next generation. Traditional legal education must adapt to the international context, and that requires an awareness of international public and commercial law, new legal skills in negotiations, problem-solving, advocacy and cross cultural dimensions - and lawyers who are committed to the highest standards of professional ethics and a servant-heart to enable developing nations to develop democratic and free societies and markets. Lawyers must be about more than power and status - we must recover the dimensions of servanthood to the legal profession, and a recommitment to principles of justice in the law.
While the U.S. model is one major dimension of the Handong's law school, it is really much more distinctive than simply U.S. law. It is a different conception of the leadership character and legal skills that Korea needs for the next millennium.
2.Please give some detail on the curriculum you have in your law school.
The curriculum is a three full year, 105 credit hour, demanding program that includes a comprehensive approach to developing the knowledge and skills essential for legal leadership. At the core is a basic U.S.-type program in traditional subjects such as torts, contracts, property etc., but then also major components in several areas: First, international areas (such as comparative law, international trade and business law, human rights, and int'l public law). Second, a focus on legal skills such as negotiations, trial advocacy, legal analysis, contract planning such as joint ventures, and legal counseling. Third, curricular aspects which focus on foundational principles such as jurisprudence, Christianity and law, ethics and leadership principles. We believe that law, at its most basic character, is about values and visions - and lawyers need a clear sense of convictions about human dignity, duties and rights, and passions for justice.
We believe law today is much more than codes and procedural rules - it is multi-dimensional and interdisciplinary. Lawyers must understand the cultural issues of our day, principles of liberty and democratic institutions, and the major political, economic and social forces that are shaping law and public policy. Thus the curriculum involves exposure to contemporary issues through a weekly FORUM. In just the last few months we have had FORUM debates on the Iraq War, on Korea's Sunshine Policy and North Korean Refugee Issues.
3.Is Handong International Law School licensed by ABA or is there any system that the graduates of HILS can access the BAR exam?
No law school outside the U.S., with the narrow exception of some Caan schools, can be formally accredited by the American Bar Association. However, the states within the U.S. have their own rules about who may take bar exams or be authorized to practice law in their jurisdictions. Some states permit graduates of foreign law schools to take bar exams, some require special permission. Still others condition admission to exams on completing a certain number of hours at a U.S. based school or completing an LL.M. So there are clearly a range of ways in which Handong graduates may take U.S. bar exams. Handong's curriculum and links are focused on assuring the kind of program which meets the highest academic expectations.
While there are no formal means for ABA accreditation, ABA standards are published and Handong seeks to comply with the academic and curriculum. In fact, the curriculum exceeds ABA requirements. In addition, Handong has cooperative agreements with several ABA accredited schools which authorize exchanges and Handong students may spend summers of semesters at these schools which will further our credibility in the U.S. context. We anticipate further links not only with U.S. schools, but Asian institutions as well. Thus is part of what it means to be an "international" law school. This summer we had students studying at two U.S. schools, - in human rights and trial advocacy programs, and some students will be in a special IP-IT program in the spring at John Marshall Law School.
4.What is the plan for the career & placement of HILS graduates?
Placement is a major issue with any graduate program. One of the attributes of a law degree in the western context is that it is a "ticket" to a very wide range of career options. Obviously one option is a traditional law practice, but many law graduates also work in the business context as in-house counsel and as members of management, others work in public or private agencies of all kinds including NGO's, advocacy groups, and legislative or administrative agencies. Still others, especially at Handong, are keenly interested in the international context and being part of the rapidly changing reforms developing in Asia. A mark of a good legal education is that it challenges students with new options and opportunities that perhaps had not even been considered.
So our task is first to equip students with a wide range of skills and knowledge, and secondly, to expose them to career options, and finally to create links with the legal community, business and government (national and int'l) where they could serve. We have been blessed and encouraged with the diversity of our students whose professional backgrounds and interests are diverse and expanding. In today's international, cross-cultural world, they will be well trained - in law, culture and language - for leadership.
5. What is the vision of HILS?
The vision is to offer a distinctive, high quality, demanding program that meets the 21st century needs. We recognize that our program will not be for everyone, and that there are many very high quality institutions of higher education in Korea. But our curriculum is distinctive and our style of education - emphasizing student participation and initiative, training lawyers as advocates and agents of change - and a commitment to spiritual and moral principles will attract a cadre of students who want, as the University says in it motto, "to change the world." To create that kind of students is more than adding up the credit hours - it happens in a community of learning that encourages initiative and imagination. It happens with a faculty committed to students and a high vision of lawyering.
