President Lee’s shameful pardons could set a dangerous precedent

President Lee Myung-bak and his followers have never had much concern with morality or shame. The country has been sickened, and social justice critically undermined, by the various sordid deeds they have carried out over the past five years. Now, with their stench yet to dissipate, Lee has managed to exceed even his own levels of shamelessness by granting special pardons to corrupt confidantes like Choi Si-joong and Chun Shin-il - all in the face of widespread public disapproval. As if that weren’t enough, he also bestowed medals on 129 of his associates, including former Minister of Strategy and Finance Kang Man-soo among them. The authority invested in presidents is something for them to use for the good of the people, not for their own personal interests. Yet here we have President Lee continuing to the bitter end in using his authority for his own personal ends.

The power to grant pardons is being used to offer New Year’s gifts to cronies guilty of abusing their power; the right to bestow medals and honors has become a veritable buffet for them to dig into. In addition to the brazen lack of concern for how his deeds will be taken by the public, you can also sense the arrogance of a man who considers himself untouchable. He has opted for back-alley loyalty to his buddies and flunkies over his obligations to the people he is supposed to serve. Adding to the foul taste of all this is the ridiculous talk about “law” and “principle” that he spewed while granting the special pardons. By abusing his authority to grant them, he showed his contempt for the legal system and shook the very foundations of constitutionalism.

Seeing this special segment of society whose members get to waltz out of prison simply by dint of their relationship with the president is enough to plunge South Korea’s working class into feelings of helplessness and legal nihilism. Lee has made a habit over the years of talking of “law” and “order” while harassing his opponents. They are words he would never have spoken if he had any conscience. Lee’s shallow hucksterism was once again evident in his inclusion of President-elect Park Geun-hye’s associate Seo Cheong-won among the pardon recipients. The whole thing stinks of quid pro quo logic: you turn the other way on my associates’ pardons if I let one of yours go. A few of the others were opposition politicians - presumably intended to quiet objections from that corner. Yet he refused pardons to one of the six people arrested in connection with the Yongsan tragedy, rather than letting all of them go. In other words, while freely releasing shameless abusers of authority like Choi Si-joong, he was stingy about granting a true pardon for the sake of social unity.

As we look at these pardons, we cannot help thinking of the responsibility borne by Park Geun-hye. No matter how shamelessly a sitting president might act, the laws of power dictate that he cannot throw pardons around so freely if the next president objects strongly enough. Although Park’s camp did voice some objections to the pardons, we cannot help wondering just how sincere they were. Now the next administration faces the inevitable task of reinvestigating the charges of corruption and improprieties committed by members of the current one, including Lee himself. This is the only way to put justice and the rule of law back in place. If Park’s administration decides to ignore Lee’s end-of-term abuses, it will live on forever as a terrible precedent.
